These Terms of Service ("Terms") govern your use of arkiebass.com (the "Service"), operated by ArkieBass ("we," "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. What the Service Is
ArkieBass is record-keeping software for fishing clubs: rosters, tournament schedules, boat pairings, weigh-in results, and season standings. It is a tool for organizing information that clubs provide. We are not a party to any club's tournaments, rules, entry fees, wagers, pots, prizes, or payouts, and we do not process or hold money on behalf of clubs or anglers.
2. Accounts
- You must be at least 13 years old to create an account.
- You are responsible for keeping your password confidential and for activity under your account.
- Club admins are responsible for the accuracy of the data they enter and for who they share their club's join code with.
- Provide accurate information and keep your email current so we can reach you about your account.
3. Club Data and Results
Your club owns the data it enters. Placements, points, and standings displayed by the Service are calculated from the numbers a club's admin enters, using the scoring rules described in the app. Each club is solely responsible for verifying its own results, resolving scoring disputes, and administering its own prizes, titles, and awards. The Service's calculations are provided as a convenience and are not an official ruling on any competition.
4. Acceptable Use
You agree not to: attempt to access other clubs' data or accounts that aren't yours; probe, disrupt, or overload the Service; use the Service for anything unlawful; or upload content that is abusive, infringing, or harmful. We may suspend or terminate accounts that violate these Terms.
5. Availability and Changes
We aim to keep the Service available and your data backed up, but we do not guarantee uninterrupted availability or that data will never be lost. We may modify, add, or remove features at any time. We recommend clubs periodically export their standings and results using the built-in export tools.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOST PRIZES OR TITLES, OR DISPUTES BETWEEN CLUB MEMBERS — ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) TWENTY-FIVE DOLLARS ($25).
8. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your club's tournaments or prize administration, or your violation of these Terms.
9. Termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate access for violation of these Terms or to protect the Service, with notice where practical.
10. Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Pulaski County, Arkansas, and you consent to their jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will update the effective date and note the change on this page. Continued use after changes take effect constitutes acceptance.
